1. Agreement to Terms

These Terms of Use ("Terms") constitute an agreement between you ("you" or "User") and BeMyLink ("BeMyLink," "Company," "we," "our," or "us") governing your access to and use of the BeMyLink mobile application for iOS and Android (the "App").

By downloading, installing, accessing, tapping to accept, granting permissions for, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms apply only to the App. They do not govern the BeMyLink website, WordPress plugin, Wix app, merchant dashboard, browser extension, APIs, business integrations, website-owner services, or merchant analytics tools, which may be governed by separate terms.

2. Pre-Incorporation Notice

BeMyLink is currently an early-stage technology project. We intend to incorporate a parent entity in the State of Delaware, USA, and may operate through an Israeli subsidiary, affiliate, or related entity. Upon incorporation or corporate restructuring, rights and obligations under these Terms may be transferred or assigned to the incorporated entity or related entities to the extent permitted by law.

If BeMyLink incorporates, changes its corporate structure, or transfers operation of the App to a company or affiliate, we may update these Terms and provide notice through the App, website, app-store listing, email if available, or another reasonable method.

3. Eligibility and Minimum Age

You must be at least 16 years old to use the App. By using the App, you represent and warrant that you are at least 16 years old.

• Users under 13 are strictly prohibited from using the App under any circumstances.

• Users aged 13 to 15 may not use the App. The App does not offer a parental consent pathway for users under 16.

• If a higher minimum age applies in your jurisdiction, you may use the App only if you meet that higher age requirement.

If we discover that a user under 16 has used the App, we may terminate or restrict access and delete associated data where technically possible and legally appropriate. Parental inquiries regarding minors may be directed to Hello@BeMyLink.ai.

4. Nature and Purpose of the App

BeMyLink is a personal shopping, inspiration, and online-content memory tool. It helps users organize eligible screenshots and return to products, pages, recipes, ideas, fashion items, home decor, travel ideas, events, restaurants, educational references, and similar content using OCR, AI-assisted categorization, duplicate detection, and link-reconstruction logic.

The App is intended only for ordinary, non-sensitive personal organization of online content. It is not intended to function as:

• a cloud photo backup service;

• a document vault, secure archive, identity vault, password manager, or evidence repository;

• a financial, banking, tax, payment, insurance, credit, debt, or investment tool;

• a medical, health, therapy, psychological, biometric, diagnosis, treatment, or wellness record system;

• a legal document archive, government form archive, litigation file, or official-record system;

• a messaging, email, private conversation, social-media monitoring, or communications archive;

• a surveillance, profiling, discrimination, or public discovery tool;

• a general image scanner or full gallery scanner.

Any use inconsistent with the App's purpose is unsupported and may result in content being skipped, blocked, deleted, refused, restricted, or not processed.

5. No Mandatory User Accounts / Guest Mode

The App may operate without mandatory account creation, usernames, passwords, or user profiles. Identification, if used, may rely on anonymous or pseudonymous device or installation identifiers. You are responsible for securing your own device, device account, operating-system settings, and any content stored on your device.

Because the App may operate without traditional accounts, some features, deletion requests, recovery options, or privacy request verification may be technically limited, as described in the App Privacy Policy.

6. User Content

6.1 Ownership

You retain ownership of screenshots, links, images, notes, edits, saved items, and other content you make available through the App ("User Content").

6.2 Limited License to Operate the App

By making User Content available through the App or by granting permissions that allow the App to process eligible screenshots, you grant BeMyLink a limited, non-exclusive, worldwide, royalty-free license to host, store, process, analyze, display, categorize, convert to different technical formats as required, and otherwise use User Content solely as technically necessary to provide, maintain, secure, debug, support, and improve the App and its App-related features.

This license does not give BeMyLink ownership of your User Content and does not permit BeMyLink to use your User Content for unrelated advertising, sale, or public sharing purposes.

This license does not permit BeMyLink to use your User Content to train AI or machine learning models deployed for purposes beyond providing features to you through this App, unless you separately consent to such use.

6.3 Your Responsibility

You are responsible for your permission choices, for using the App only for appropriate non-sensitive content, and for not intentionally submitting, retaining, organizing, or processing prohibited content through the App. Because the App may automatically detect screenshots based on device permissions, you should review your saved items and delete any content you did not intend to save or that falls outside the App's intended purpose.

7. Screenshots, Device Permissions, and Consent to Automated Detection

If you grant device permissions, the App may access screenshots or media items made available to the App for screenshot-import and screenshot-organization functionality. The App is designed to use such permissions only for App features related to eligible screenshot content.

The App may automatically detect screenshots from the screenshots folder or screenshots area of your device after you grant the relevant device permission. Depending on your device, operating system, and permission choices, this may include background detection of newly taken screenshots and processing without requiring you to manually select each screenshot.

On iOS and Android, permission categories needed to access screenshots may technically expose access to other photos or media on your device. BeMyLink is designed to use this permission solely for App functionality and does not intentionally scan, analyze, or retain general personal photos. However, we cannot guarantee that no incidental access occurs due to operating-system behavior, permission categories, limited/full access choices, user selection, or device-level limitations outside our control.

By granting screenshot or photo library permissions and using the App's automatic screenshot detection features, you consent to BeMyLink's automated processing of screenshot content made available through those permissions, including background detection of new screenshots, OCR text extraction, duplicate detection, category detection, source detection, return-link detection, and AI-assisted analysis. This consent is required for the App's core functionality.

You may withdraw consent at any time by revoking or limiting the relevant device permissions in your device settings. Doing so may limit or prevent App functionality.

8. AI, OCR, and Technology Limitations

The App may use OCR, image analysis, machine learning, large language models, heuristics, rules, source-detection logic, duplicate-detection logic, safety filters, and other automated systems to analyze eligible screenshots, identify products or brands, classify categories, generate descriptions, detect unsupported content, and attempt to reconstruct return links.

AI/OCR outputs may be inaccurate, incomplete, outdated, unavailable, misleading, or contextually incorrect. We do not guarantee the accuracy of any AI-generated or automatically generated output.

AI-generated categorizations, titles, sources, tags, summaries, and return links are not professional findings, recommendations, endorsements, warranties, or determinations of any kind. They are automated organizational suggestions only.

Return links or reconstructed URLs generated by the App are estimates derived from screenshot content and may point to incorrect products, outdated pages, different prices, sold-out items, redirected pages, broken pages, unrelated content, or different products or services than the original source. You should always verify the destination of any link before completing a purchase or taking any action.

You remain solely responsible for verifying any product, price, availability, retailer, link, category, content, offer, or information before relying on it. BeMyLink is not responsible for purchases, transactions, losses, decisions, or actions taken based on AI/OCR outputs or reconstructed links.

9. No Professional Advice

The App does not provide legal, medical, financial, investment, tax, commercial, safety, identity, credit, insurance, employment, housing, emergency, or other professional advice. Any labels, categories, descriptions, suggestions, links, or saved-item details are informational and organizational only.

10. Prohibited and Unsupported Content / No-Touch Policy

The App does not support and must not be used to submit, process, store, organize, retain, display, preserve, promote, transmit, or share sensitive, dangerous, illegal, exploitative, private, confidential, or unsupported content, including:

• private chats, direct messages, WhatsApp, iMessage, Telegram, emails, contact lists, call logs, or personal conversations;

• passwords, login codes, authentication screens, one-time codes, recovery codes, security credentials, QR codes for login or payment, or crypto wallet recovery phrases;

• bank accounts, credit cards, financial statements, tax documents, insurance documents, payment credentials, salary slips, debt information, or investment records;

• medical, health, psychological, therapy, biometric, genetic, disability, prescription, test-result, or wellness information;

• government IDs, passports, driver's licenses, visas, immigration documents, official forms, or identity documents;

• legal documents, contracts, court documents, police reports, privileged materials, confidential business information, trade secrets, or legal evidence;

• children's personal information, children's images, school documents, medical records, identification documents, or unsafe child-related content;

• content involving weapons, explosives, bombs, ammunition, terrorism, violent extremism, criminal activity, illegal drugs, unsafe instructions, or dangerous activity;

• sexual, exploitative, abusive, pornographic, violent, or harmful content, especially any content involving or appearing to involve minors;

• content that infringes intellectual property, privacy, publicity, contractual, confidentiality, or other rights;

• any content that appears unlawful, harmful, unsafe, highly sensitive, or outside the App's ordinary shopping/inspiration purpose.

You agree not to intentionally use the App to save, keep, submit, process, retain, organize, preserve, transmit, or share prohibited, illegal, unsafe, or highly sensitive content.

If the App's automated systems detect signals that content may fall into a prohibited or highly sensitive category, BeMyLink may, in its sole discretion and without prior notice, skip it, block it, delete it, avoid creating a saved card, suppress OCR or image storage, store only a limited safety status, refuse to process or display it, or take other protective measures.

BeMyLink may take protective action, including deletion, without prior notice where it determines in good faith that content poses a safety, legal, security, privacy, or policy concern. You acknowledge that such deletion may result in permanent loss of that content and waive any claim arising from good-faith protective deletion, refusal to process, refusal to display, or refusal to retain content under this Section.

Automated detection systems may not be perfect. BeMyLink does not guarantee that all prohibited content will be detected or that all permitted content will be accepted.

11. Acceptable Use

You agree not to:

• use the App for unlawful, harmful, abusive, exploitative, unsafe, or prohibited purposes;

• reverse engineer, decompile, disassemble, modify, or attempt to extract source code, models, prompts, workflows, or non-public logic;

• modify, resell, sublicense, lease, rent, distribute, or commercially exploit the App without authorization;

• upload, submit, transmit, or introduce malware, viruses, malicious code, automated attacks, or harmful content;

• attempt unauthorized access to systems, accounts, APIs, storage, cloud infrastructure, or other users' data;

• interfere with the security, integrity, performance, or availability of the App;

• scrape, crawl, harvest, copy, export, or systematically extract data from the App without authorization;

• violate intellectual property, privacy, publicity, confidentiality, contractual, or other rights of any third party;

• use the App for surveillance, profiling, discrimination, harassment, manipulation, or harm;

• attempt to circumvent, disable, exploit, or undermine BeMyLink's content-detection systems, safety filters, permission controls, rate limits, or No-Touch Policy mechanisms.

Violation may result in suspension, termination, deletion of content, refusal of processing, restriction of features, or other actions we consider appropriate.

12. Intellectual Property

All software, code, design, user interface, trade names, trademarks, branding, text, databases, models, workflows, algorithms, product architecture, content-detection logic, and other elements of the App are owned by or licensed to BeMyLink and are protected by intellectual property and other laws.

No rights are granted except the limited right to use the App in accordance with these Terms.

13. Third-Party Brands, Platforms, Retailers, and Links

BeMyLink is independent and is not affiliated with, endorsed by, sponsored by, or officially connected to any third-party retailer, platform, marketplace, brand, website, app, or service that may appear in or be linked from the App.

All third-party trademarks, logos, product names, images, screenshots, websites, and content remain the property of their respective owners. References are used only for identification, organization, navigation, or user-saved content display.

You are solely responsible for interactions with third-party websites, retailers, platforms, or services, including purchases, payments, returns, warranties, pricing, availability, terms, privacy policies, and security practices. BeMyLink does not control and is not responsible for third-party websites, products, prices, availability, security, privacy practices, or terms.

14. Copyright / DMCA Complaints

If you believe content within the App infringes your copyright, you may contact us at Hello@BeMyLink.ai. We may remove or disable access to content in response to valid notices, good-faith concerns, or legal requests.

To qualify for protection under the Digital Millennium Copyright Act (17 U.S.C. Section 512), BeMyLink intends to designate a registered DMCA agent with the U.S. Copyright Office when appropriate. Until that registration is complete, copyright notices should be sent to Hello@BeMyLink.ai.

A valid DMCA notice should include: (i) identification of the copyrighted work claimed to be infringed; (ii) identification of the allegedly infringing material and information sufficient for BeMyLink to locate it; (iii) your contact information; (iv) a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (v) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

15. App Availability, Changes, and Limits

The App is provided as an evolving MVP product. Features may be incomplete, experimental, unavailable, inaccurate, interrupted, limited, or modified over time.

We may update, modify, suspend, discontinue, or limit the App or any feature at any time. We may impose technical limits, usage limits, storage limits, import limits, rate limits, safety restrictions, eligibility restrictions, or feature restrictions at any time, with or without prior notice, in our sole discretion, subject to applicable law.

Where the App has been offered as a paid service and we discontinue a material paid feature, we will make reasonable efforts to provide advance notice and, where applicable, a prorated refund or credit for unused paid periods, to the extent required by applicable law, app-store rules, or the payment platform rules that apply.

16. Future Payments and Subscriptions

The App may currently be free of charge during the MVP phase. We may introduce paid plans, subscriptions, premium features, credits, usage-based limits, or other monetization in the future. If we do, pricing, billing, renewal, cancellation, and refund terms will be disclosed before charges are incurred.

If payments are processed through Apple App Store, Google Play, or another third-party payment provider, billing, subscription management, cancellation, refunds, taxes, and payment disputes may be governed by the applicable platform's rules and processes. BeMyLink may not receive full payment card details when payments are handled by such providers.

17. App Stores and Platform Rules

The App may be distributed through third-party app stores, including Apple App Store and Google Play. Platform rules may affect App availability, features, billing, subscriptions, permissions, age ratings, content policies, updates, and user controls. BeMyLink's ability to offer certain features may be limited by or subject to the rules of the applicable app-store platform.

18. Privacy

Use of the App is also governed by our App Privacy Policy, which explains how information is collected, used, processed, disclosed, retained, and protected. The App Privacy Policy is incorporated into these Terms by reference.

19. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEMYLINK DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.

We do not warrant that the App will be uninterrupted, secure, accurate, complete, compatible with every device, free from harmful components, or capable of recovering every link, detecting every source, classifying every screenshot correctly, or blocking every prohibited screenshot.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEMYLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES, OR FOR LOSS OF DATA, LOSS OF CONTENT, LOSS OF BUSINESS, LOSS OF GOODWILL, DEVICE ISSUES, THIRD-PARTY ACTIONS, PURCHASE ERRORS, SECURITY INCIDENTS OUTSIDE OUR REASONABLE CONTROL, OR RELIANCE ON AI/OCR OUTPUTS OR RECONSTRUCTED LINKS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEMYLINK'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BEMYLINK, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50.00 IF YOU PAID NOTHING TO BEMYLINK DURING THAT PERIOD.

Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, the limitations apply only to the maximum extent permitted by law.

21. Indemnification

You agree to defend, indemnify, and hold harmless BeMyLink and its founders, officers, directors, employees, contractors, service providers, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to your intentional misuse of the App, your User Content, your violation of these Terms, your violation of law, or your violation of third-party rights.

Notwithstanding the foregoing, you are not required to indemnify BeMyLink for claims arising from BeMyLink's own gross negligence, willful misconduct, fraud, or violation of applicable law.

22. Force Majeure

BeMyLink shall not be liable for any delay, failure, interruption, data loss, or inability to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, cyberattacks, infrastructure failures, cloud-provider outages, internet or telecom failures, governmental actions, labor disruptions, security incidents, third-party service failures, or app-store actions outside BeMyLink's reasonable control and not caused by BeMyLink's own violation of platform rules.

23. Governing Law, Mandatory Rights, and Venue

Until incorporation of a Delaware entity, these Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Upon incorporation of a Delaware entity, these Terms may be updated to reflect Delaware law or another appropriate governing law.

This governing law clause does not limit or override mandatory rights available to you under applicable law in your jurisdiction, including privacy, consumer protection, and app-store rights that cannot be waived by contract.

For California residents, nothing in this governing law clause limits your rights under the CCPA/CPRA, UCL, CLRA, FAL, CIPA, or any other California statute that cannot be waived by contract. Those statutory rights are governed by California law regardless of this clause.

Subject to the dispute resolution clause below and mandatory consumer protection laws, any litigation arising under these Terms shall be brought exclusively in the courts of Israel prior to incorporation of a Delaware entity, and in the courts of the State of Delaware after incorporation of a Delaware entity, unless applicable law gives you the right to bring a claim in another forum that cannot be waived.

24. Dispute Resolution, Arbitration, and Class Action Waiver

Please read this Section carefully. It affects how disputes are resolved.

24.1 Informal Resolution First

Before filing any formal claim, you agree to contact BeMyLink at Hello@BeMyLink.ai and attempt to resolve the dispute informally for a period of at least thirty (30) days. Please include your name or contact email, a description of the dispute, and the relief you seek. We will make reasonable efforts to resolve disputes in good faith.

24.2 Binding Individual Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App - except for claims filed in small claims court and except for the exceptions below - shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. This arbitration agreement is governed by the Federal Arbitration Act.

24.3 Class Action and Representative Action Waiver

You and BeMyLink agree to resolve disputes only on an individual basis. To the maximum extent permitted by law, you waive any right to bring or participate in a class action, class arbitration, representative action, private attorney general action, collective action, or consolidated proceeding.

24.4 Opt-Out Right

You may opt out of this arbitration agreement by emailing Hello@BeMyLink.ai within thirty (30) days after you first agree to these Terms. Your opt-out notice must state that you opt out of arbitration and must include enough information for us to identify your request. Opting out of arbitration does not opt you out of any other part of these Terms.

24.5 Exceptions

Either party may bring an individual claim in small claims court where permitted by law. Either party may also seek injunctive or equitable relief in court for intellectual property infringement, unauthorized access, security abuse, or imminent harm. For California residents, nothing in this Section waives any non-waivable right to seek public injunctive relief under California law.

24.6 Severability of Dispute Terms

If any part of this Section is found unenforceable, that part will be severed or modified to the minimum extent necessary, and the rest of this Section will remain in effect to the maximum extent permitted by law. If the class action waiver is found unenforceable for a particular claim, then that claim may proceed in court only to the extent required by law.

25. Termination

You may stop using the App at any time. We may suspend, restrict, or terminate access to the App or any feature if we believe you have violated these Terms, used the App in an unsupported or unsafe manner, created legal, privacy, safety, security, or operational risk, or engaged in misuse.

Termination may result in loss of access to features or content. You are responsible for maintaining your own copies of any content that is important to you outside the App.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, our practices, laws, corporate structure, privacy practices, platform requirements, paid features, or services. Material changes will be communicated through the App, website, app-store listing, email if available, or another reasonable method.

For material changes that significantly expand our rights, your obligations, dispute-resolution terms, payment terms, or privacy-related terms, we will aim to provide advance notice where reasonably practicable and will seek consent where required by applicable law. Continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms, unless applicable law requires a different form of notice or consent.

27. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

28. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. BeMyLink may assign, transfer, or delegate these Terms and related rights or obligations to an incorporated entity, affiliate, successor, acquirer, or related company as part of incorporation, reorganization, financing, merger, acquisition, sale of assets, or similar transaction, to the extent permitted by law.

29. Entire Agreement

These Terms, together with the App Privacy Policy, any supplemental terms that you expressly accept within the App (such as terms for paid features), and any additional legal notices required by applicable law, constitute the entire agreement between you and BeMyLink regarding the App.
